Doing Business with Venezuelan Clients Demands Heightened Compliance Discipline

§

OFAC sanctions, FATCA reporting limits, and local banking instability have turned Venezuela into a high-risk jurisdiction for U.S. and cross-border advisers. Here's what RIAs and BDs need to get right.

Doing business with Venezuelan clients or intermediaries demands heightened compliance discipline.

OFAC sanctions, FATCA reporting limits, and local banking instability have turned Venezuela into a high-risk jurisdiction for U.S. and cross-border advisers.

Here's what RIAs and BDs need to get right:

  • Screen every party against the OFAC SDN List, including beneficial owners, intermediaries, and family members.
  • Document source of wealth and source of funds thoroughly. Payments from Venezuelan accounts or through third-country banks often require enhanced due diligence.
  • Review all custodians and payment channels. Correspondent banks may block or delay transfers involving Venezuelan entities, even if not on the SDN List.
  • Reassess client risk ratings. Treat Venezuelan exposure as "high-risk" and document why you still maintain the relationship.
  • Stay clear of sanctions evasion patterns. Transfers through proxies or offshore entities can trigger red flags.

Cross-border business with Venezuela isn't prohibited, but it's never routine.

ICS helps RIAs audit cross-border onboarding and sanctions procedures to meet OFAC, SEC, and state exam expectations.
